Terms and Conditions (T&C)

1. Scope of Application

These Terms and Conditions apply to all contracts concluded via the online shop between the operator of the webshop (hereinafter referred to as the “Seller”) and consumers within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz – KSchG).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the button “place order with obligation to pay”, the customer submits a binding offer to purchase the selected goods.

The contract is concluded only when the Seller accepts the order by sending an order confirmation by email or by dispatching the goods.

3. Contract Language

Contracts may be concluded in German or English. The version selected by the customer at the time of ordering shall be decisive.

4. Prices and Shipping Costs

All prices are stated in euros and include statutory value added tax (VAT).

In addition to the stated prices, shipping costs may apply. These will be clearly indicated during the ordering process.

For products priced by weight (in particular personalised organic meat products), the prices shown are indicative prices only. The final price is based on the actual weight of the delivered goods and will be communicated to the customer prior to dispatch or at the latest together with the invoice.

5. Payment Terms

The customer may use the payment methods offered in the online shop. The charge will be made in accordance with the selected payment method during the ordering process.

The Seller reserves the right to exclude individual payment methods.

6. Delivery and Shipping Area

Delivery is made to Austria and Germany. An extension to other EU Member States remains reserved.

Delivery times are stated in the online shop. Partial deliveries are permissible insofar as they are reasonable for the customer.

7. Retention of Title

The goods remain the property of the Seller until full payment of the purchase price has been received.

8. Age Restriction

Alcoholic products are sold exclusively to persons of legal age. By placing an order, the customer confirms that they have reached the legally required minimum age. The Seller reserves the right to carry out an age verification.

9. Right of Withdrawal

Consumers generally have a statutory right of withdrawal in accordance with the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz – FAGG).

The withdrawal period is fourteen (14) days from the day on which the customer or a third party designated by the customer acquires physical possession of the goods.

To exercise the right of withdrawal, the customer must inform the Seller of their decision by means of a clear statement.

10. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • goods made to the customer’s specifications or clearly personalised (e.g. organic meat products individually assembled according to weight),

  • goods that are liable to deteriorate rapidly or have a short expiry date,

  • sealed goods which are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery,

  • digital content (e.g. vouchers) if performance has begun and the customer has expressly consented and acknowledged the loss of the right of withdrawal.

11. Return Shipping Costs

In the event of a valid withdrawal, the customer shall bear the direct costs of returning the goods.

12. Warranty

Statutory warranty rights apply.

13. Liability

The Seller shall be liable only for damages caused by intent or gross negligence. In cases of slight negligence, the Seller shall only be liable for the breach of essential contractual obligations and limited to foreseeable damages typical for this type of contract.

Liability for personal injury remains unaffected.

14. Vouchers

Vouchers are redeemable exclusively in the online shop, are non-transferable and cannot be redeemed for cash unless expressly stated otherwise.

15. Online Dispute Resolution

Consumers may submit complaints to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final Provisions

Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions remain unaffected.

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
